Title:	從司法院法學資料庫隱私權問題看政府資訊委外的發展與問題

Abstract:	本文從司法院法學資料庫以保護隱私權為由,刪除當事人姓名等內容出發,並從發展數位內容產業的觀點,探討政府資訊委外的發展模式與其所衍生的問題,提出未來資訊委外所可能考慮的因素。本文認為,政府所掌控的基本資料不但攸關民衆與企業,更相當於數位內容產業的樞紐設施,與政府發展數位內容直接有關,因此本文建議能透過競爭機制,適度開放政府所掌控的基本資料,以供業者加值利用,不但可確保資訊內容的正確,亦可避免政府資料的壟斷化。另一方面則應建立監督機制,強化對承包業者的監督,以免發生業者利用其所取得的資料進行非委外目的之利用。
