    Abstract: 為了保護新興的電腦軟體、生物科技等智慧財產權,並強化傳統之專利、商標、著作權等智慧財產權之保護,以遏止仿冒的蔓延,美國、歐盟等已開發國家原本希望透過當時國際間的智慧財產權條約如巴黎公約的管道,擴大巴黎公約的保護範疇,以涵蓋新興的智慧財產權。但是卻因為開發中國家七十七集團的反對而未能盡其功,因此美歐等國乃另起爐灶,於當時的關稅暨貿易總協定(GATT)中,增加「與貿易有關的智慧財產權協定」(TRIPS),建構了嶄新的全球保護智慧財產權之架構。也因此TRIPS不但是第一個對智慧財產權作全面性規定的國際條約,也是第一個對智慧財產權保護要求會員國應符合國際最低保護標準的條約。
