Title:	二○○二年德國民事訴訟法改革－總則與第一審部分

Abstract:	德國民事訴訟法改革法(ZPO-RG)已於二二年一月一日施行,依聯邦政府於二年九月六日所提民事訴訟法改革法草案理由部分所載,此次民事訴訟法修正之理由為:民事訴訟應更接近人民、更有效率及更透明化。現行程序法規、上訴途徑之功能及法院結構已不足肆應追求法律救濟人民之權利實現與經濟之要求,則法院應具備使民事訴訟能更精確實現社會功能之機制,以確保法律和平與法律安定性。民事訴訟法之修正應依循改善結構條件,使訴訟當事人能更迅速實現權利及獲得一為其所能明瞭與接受之裁判,以提高人民對實體權利之滿意度與促進法律和平之持續強化。
