Title:	以通姦為離婚事由之相關訴訟問題

Abstract:	就違法取得證據是否可於民事訴訟中被運用,在學說上有正反不同見解。本文認為:違法取得證據之可利用性問題之考慮面向,應包括民事程序法之目的,尤其係實體請求權之貫徹及為達成此一目的之探求真實必要性之關聯,並且對憲法與一般法律之規範目的(尤指被違反者)與價值之確認及保護,特別係人性尊嚴、隱私權、人格權、財產權、自由權、住宅自由等價值之相互間對抗與衡量;另外,須對屬於法政策層面之一般預防目的及誠信原則,亦應為充分考量。而台灣高等法院九十年度訴字第一三九號民事判決即認為:於民事程序中倘允許採認違法取得之證據,無異形同對於違法行為之鼓勵。是於民事程序亦應透過個案衡量兩造權利受保護之必要性,尤其是被違反法規所保護之法益及舉證人於訴訟上利益,在兼顧比例原則下具體衡量,對於違反程序法或實體法之規定所取得之證據資料,衡諸正當法律程序、訴訟誠信、法秩序統一性、抑制違法收集證據等價值,仍須在一定限度內,就違法取得證據資料之證據能力加以限制之必要。
