Title:	民事訴訟法:第一講假處分程序(下)

Abstract:	定暫時狀態假處分與一般假處分之不同乃在於前者係為防止發生重大之損害或避免急迫之危險或有其他相類之情形,而後者係為保全將來之執行。民事訴訟法第五三八條規定:「於爭執之法律關係,為防止發生重大之損害或避免急迫之危險或有其他相類之情形而有必要時,得聲請為定暫時狀態之處分。(第一項)前項裁定,以其本案訴訟能確定該爭執法律關係者為限。(第二項)第一項處分,得命先為一定之給付。(第三項)法院為第一項及前項裁定前,應使兩造當事人有陳述意見之機會。但法院認為不適當者,不在此限。(第四項)」據此,定暫時狀態假處分之要件包括:有爭執之法律關係存在及有定暫時狀態之迫切必要等。
