Title:	民事訴訟法新修正－上訴審及其他程序部分

Abstract:	立法院於九十二年一月十四日三讀通過民訴法修正案,其修正內容範圍頗大,及於民訴法之總則部分、第一審至第三審部分及其他程序(包括異議與抗告程序、再審程序、保全程序及公示催告程序等)。其中,就上訴審及其他程序部分有重大之變革,例如,於第二審提出新攻擊防禦方法之原則性禁止、第三審之上訴許可制度、飛躍上訴制度、第三人撤銷之訴及假扣押、假處分功能之強化等。其與人民訴訟權之保障、訴訟經濟等憲法及程序原則攸關至鉅,值予重視。本文即擬就此等上訴審及其他程序部分之修正,予以評析,必要時且研介相關德國法制,用供學術及實務發展之參考。
