    Abstract: 本文係針對中國大陸統一證據法學者稿(第三稿)作一評釋。首先,就制定統一證據法之必要性,本文提出若干質疑:(一)訴訟法及證據法是否以具有可回轉性來區分,其基準似非完全明確。(二)民事、刑事程序於證據法之作用與要求未必相同。(三)應注意大陸法系的程序法特性與美國法未必相同。(四)偵查階段之證據法則,欲以刑事訴訟法調整,實為統一法典化不足之表徵。其次本文分別就本證與反證的意義、舉證負擔動態論、證明妨礙等規定,從德國法背景指出其缺失;最後提出關於當事人聽取與當事人訊問之區別、損害賠償額確定等問題似有規定必要,值得再予推敲。
