Abstract:	甲於民國九十九年十月二十五日騎機車遭闖紅燈之乙駕駛之車輛追撞，致受有重傷害，需持續治療。經鑑定，乙有百分之一百過失，而乙為汽車所有人，向A保險公司投保有強制汽車責任保險。甲於一○○年五月至一○一年八月間多次持醫療費用收據向A申請保險給付，共獲給付保險金新臺幣九萬元。嗣後，甲又經診斷發現因車禍傷致雙膝關節萎縮而需持續門診與復健，遂於一○二年五月，檢附一○一年十一月三日至一○二年六月三十日之醫療費用收據，共計二萬一千元向A請求給付，A則以該些醫療費用均屬一○一年十月二十四日後發生，請求權業已罹於強制汽車責任保險法所定之二年消滅時效為由拒絕給付。問A之抗辯是否有理由？
