Abstract:	法效理論與法解釋理論兩者都是法理學的重要問題,但是兩者具有何種的關係,卻少見理論之探索與建構。本論文即為此一方向下的一個嘗試,試圖透過對Jurgen Habermas及Arthur Kaufmann之法效理論的檢討,來為法效理論與法解釋論的可能銜接做一初步研究,並在此背景下對法學知識的性質做一定位。Kaufmann的法效理論主要是由檢討良知的自律與他律問題出發,主張真正的規範拘束力必定來自於個人良知之承認。Habermas在其《事實性與效力》一書中的法效理論則較為複雜。但筆者認為此一理論就其根本的性質而言,仍然是一個源自於理性法傳統的理論。亦即Habermas在此書中,仍嘗試將某種的理性概念---以其用語即為溝通理性(Kommunikative Vernunft)---建構為現代民主法治國法律之有效性與正當性之基礎。最後基於前述檢討,本文除指出Kaufmann良知理論對Habermas法效理論的補充作用外,並提出對法學知識的一個初步定性,即:法學知識為法釋義學概念架構,與支持其運作適用的各種理由的綜合闡述。這些不同層次之考量彼此如何形成一相互關聯之思考架構,則形成了一個對法學思維後設結構研究的要求。
