    Abstract: 追溯至Gilbert and Newbery(1992)，經濟學家早已觀察到技術創新可以是延堵競爭者共享市場的策略性工具之一。但常為人所忽略的是技術創新不僅關係經濟效益及市場結構，更與智慧財產法規形影不離。近年來在此經濟與法律的界面，已有眾多學者從事深入研究。其中又以專利法中之「新奇性」，「公開性」，「專利權限」等議題之鑽研者為最盛。值得注意的是專利文獻之發展大多及終於如何設計、調整一最適的專利制度，在廠商策略幸運用創新專利的分析，相對著墨不多。專利權限的寬窄，對廠商而言，具有下列特性：首先，範圍較廣的專利申請，雖預期獲利能力較高，但因專利公開所衍生之資訊外部性，也相對使得競爭者易於迎頭趕上，甚而超前。更有甚者，因專利保障範圍延伸所引發之侵權訴訟在所難免，而專利持有人面臨不完全專利保障，未必能每戰皆捷。相對而言，範圍較窄，較特定專利申請，雖預期獲利能力有限，但受侵權後之專利保障較高，未嘗不是最適策略。有鑑於此，本研究計畫將試圖從內生性專利權限的角度，切入正蓬勃發展的專利文獻。特定的理論模型特參考Green and Scotchmer(1995)及Chou and Haller(1995,1996)。前者模型適合處理連續性創新的利益分配。後者則對侵權行為訴訟之不確定性及相關專利法規有深入解析。本研究之結果可望對最適專利制度之設計及廠商最適專利管理等有所貢獻。
