Title:	怠惰的行政機關與訴願機關－怠為處分之課予義務訴訟之相關問題

Abstract:	人民依法向行政機關提出申請,即依法享有請求行政機關為一定作為之權利,行政機關就其申請作成之准駁決定,依申請內容發生法律上拘束力,該決定自為一行政處分。行政機關如未於一定期間內就實體為審查並進而為准駁之決定,因其怠於行使職權,致人民公法上之權利義務關係無法確定,自應給予人民救濟之機會。與行政訴訟法第五條第二項對於行政機關之駁回意思表示提起拒為處分之課予義務訴訟相較,本條第一項所規範之課予義務訴訟,即就行政機關消極不作為所設計之訴訟類型,為「怠為處分之課予義務訴訟」。而不論拒為處分之訴或怠為處分之訴,依我國行政訴訟法之規定,與撤銷訴訟同,皆採訴願程序前置原則,須經訴願程序後始得向行政法院提起課予義務訴訟。
