    Abstract: 依據歐盟將航空業納入其排放權交易機制之「航空業排放權交易指令」,所有往返於歐盟會員國之機場、以及起飛自或降落於歐盟會員國機場的國際空運活動,均必須於二○一二年一月一日起正式加入歐盟的排放權交易機制。身為全球第一個採取「碳邊境措施」之立法,其所可能引發之國際法爭議,包括國際航空法與國際經貿法,值得詳加分析,此為本文之研究目的。據此,於介紹歐盟之航空業排放權交易指令之後,本文將分析歐盟此一指令與「芝加哥公約」以及「服務貿易總協定」兩個國際協定之關係,包括首先探討指令之規範是否落入此兩國際協定之管轄範圍、以及若將受相關國際協定之管轄,指令目前之規範是否符合該國際協定。初步之研究結果發現,本指令之法律屬性較偏向國際空運的管制法規,而可能不落入「服務貿易總協定」之管轄,故,芝加哥公約第十一條「空運管制之適用」下所揭示之不歧視原則於本指令之執行上將有其重要性。惟,此一初步之分析結果,尚必須視歐盟後續所頒布之細部執行規範、以及歐盟會員國執行相關之監督與管理工作的狀況而定。
    The inclusion of aviation into the EU ETS for all flights departing from and arriving at the airport of any of its Member States after 1 January 2012 is the first, and so far the only example of the so-called “carbon border measures”. It is, thus, important to analyze the legal implications of such measures from the perspective of international air law and international economic law. This article begins with an introduction of the EU aviation emissions trading legislation. Legal analysis on the applicability of and compatibility with the Convention on International Aviation and the General Agreement on Trade in Services to this EU legislation is then conducted. After preliminary research, this paper finds that the legal nature of this EU legislation is more similar to air regulations under Article 11 of the Convention on International Aviation. Furthermore, the applicability of the General Agreement on Trade in Services is less clear-cut due to the unique position of air services under the Annex on Air Transport Services. To conclude, the non-discrimina¬tion principle embodied under Article 11 of the Convention on International Aviation will be an important element in the implementation of this EU legislation. Nevertheless, this research finding will have to be revisited after more detailed implementation regulations have been adopted and the legislation has been implemented in practice.
