    Abstract: 由美國次貸風暴演變而成的全球金融海嘯,被反全球化論者指為是世貿組織金融服務貿易規範所造就之另一惡果,因此鼓吹中止杜哈回合中之金融服務貿易談判,要求將金融服務自服務貿易總協定中排除。本文為檢視這些論述之正確性,先回顧此次全球金融危機之成因,確定與市場自由化並無關聯,並進一步指出批評者在非法律觀點部分的盲點。之後,則聚焦於世貿組織金融服務貿易規範中被批評者所指摘之具體條文與承諾,藉著妥適之法律闡釋說明批評者對相關規範之誤解。本文發現相關承諾與規定既未要求會員國採取誘發危機的措施,亦未妨礙各國於危機後進行救援與重建金融秩序。對於給予會員國相當大措施裁量空間的「審慎例外」,本文以為儘管在一定程度內增加了承諾之不確定性,但也提供會員繼續推動自由化所需之保障,而使金融服務貿易談判不致因金融海嘯而完全停擺。
    The financial tsunami which emerged from the U.S. sub-prime crisis has been viewed by anti-globalists as another situation caused by the WTO rules on trade in financial services. They called for termination of negotiations on trade in services of the Doha Round and for moving financial services out of GATS. In order to verify the validity of their arguments, this article first reviewed the causes of the global financial crisis. After concluding that the causes are unrelated to market opening, it further identifies the blind spots of their views on certain non-legal aspects. Thereafter, this article concentrates its analysis on the relevant provisions and commitments of the WTO rules on trade in financial services which were criticized. Through proper legal interpretation, it explains how the relevant rules were misunderstood. It finds that none of the provisions and commitments required WTO Members to undertake measures that triggered the crisis, or prevents Members from implementing rescue plans or rebuilding a new financial order. In respect of the so-called “prudential carve-out,” while recognizing the high level of discretion it affords to Members may increase the uncertainty on commitments, this study argues that it also provides a safeguard for Members to continue the liberalization process and saves current financial trade negotiations from falling apart due to the financial tsunami.
