Title:	論運動彩券發行機構甄選文件之法拘束力——行政爭訟相關實務見解評析

Abstract:	我國截至目前為止之運動彩券發行實務，主管機關率皆選擇採行「特許模式」，透過「公開遴選」方式，指定私人作為運動彩券之發行機構。受指定發行運動彩券之民間機構參與甄選程序時所提出之企劃書等文件，及對主管機關所為之承諾，是否及如何發生法拘束力，行政及司法實務見解不一。本文對此問題進行法釋義學上之分析，以釐清相關法律關係。此外，並提出未來修法之若干建議。
