Abstract:	本號解釋之主要爭點，在於入出國及移民法（以下簡稱「移民法」）對外國人的「收容」處分，既無事前之法官保留，又未提供立即之司法救濟，是否牴觸憲法第八條保障之人身自由正當程序？而在這個主要爭點下，還有以下子爭點：壹、外國人之人身自由，是否亦受憲法第八條之保障？其保障是否應與中華民國國民相當？貳、收容是否應適用「法官保留」，由法官事前決定？或是有無其他替代之司法救濟？既有之「提審」制度可否適用？參、收容之原因與期間，有無限制？
