Abstract:	我國地方政府自2010年12月25日以降形成五直轄市之建構規模，開啟地方自治史上之新局面。原隸屬於臺北縣、臺中縣、臺南縣及高雄縣轄下之鄉（鎮、市），因所屬縣單獨改制或與其他地方自治團體合併改制升格為直轄市，致喪失原有之地方自治團體公法人屬性，「降格」為改制後直轄市內部之「區」行政層級。基此劇烈之組織變革，改制之四個新直轄市市政治理，遂遭遇區公所在現行法制下之組織及功能定位問題。本文認為，其面臨之區政治理問題與臺北市及原高雄市之區有別，故區公所在組織定性及業務功能上應另闢蹊徑。除應強化區公所之業務權責外，在組織編制上亦應滿足「在地服務」之要求。最後，更須正視各區自然及人文條件差異之事實，適度納入「依區制宜」之立法，以為分區治理之準據。
