Title:	中國大陸預防職務犯罪之評析

Abstract:	回顧反腐歷史，如果從改革開放開始算起，大陸在不同階段確有不同的做法，工作重心從「遏制」、「治本」到現在的「預防」，可以說大陸的確在反腐倡廉工作上不遺餘力。最近幾年比較具體的措施，例如2005 年1 月頒發《建立健全懲治和預防腐敗體系實施綱要》，2007 年成立國家預防腐敗局，2008 年更頒布了《建立健全懲治和預防腐敗體系2008-2012 年工作規劃》，明確指出反腐倡廉的指導思想、基本要求和工作目標。從這些動作可以看出，大陸是有心想要做到懲治和預防兩手都抓、堅持兩手都要硬，似已意識到光是加重懲處並不能解決貪腐問題，反而認為應該著重事先預防，在認知上等於是將反腐倡廉的工作窗口往前移動。預防犯罪工作是成本較低而效益較高的聰明做法，做得好既可以減少國家的經濟損失，又可以減少日後查辦案件的成本，一舉數得，只是口頭說要預防容易，真要做起來恐不輕鬆。
