    Title: 由談判利益分析兩岸協議監督機制之設計-交易成本理論觀點

    Abstract: 2014 年3 月17 日，審查《海峽兩岸服務貿易協議》的委員會迅速通過該協議。隨即因「黑箱」爭議而引發學生占領立法院議場，學生最重要的原則就是「先立法、再審查」，進而提出三項訴求，第一、立法院必須在本會期推動兩岸協議監督條例立法；第二、在完成立法之前不得審查服貿；第三、立法院程序委員會不得繼續阻擋「兩岸協議監督條例法制化」的提案。1 嗣後，隨著太陽花學運越演越烈，2014 年3 月28 日行政院長江宜樺宣布「同意兩岸協議監督機制的法制化」， 2 而在同日，反黑箱服貿民主陣線、臺灣守護民主平台與台灣人權促進會也同時提出《兩岸協定締結條例草案》， 3 而行政院隨即在同年4 月3 日通過《臺灣地區與大陸地區訂定協議處理及監督條例草案》， 4 至此，行政院版與民間版兩大版本隨即吸引輿論廣泛地討論，社會上兩種截然不同的立場對於兩個版本有迥然相異的詮釋，馬總統認為「兩岸協議監督條例草案民間版立法權凌駕行政權，造成行政部門非常大的困難根本無法執行」， 5 而行政院版亦有監督條例合法化黑箱程序之批評， 6 然而，筆者認為，綜觀政院版與民間版草案，若從不同的面向來看，皆有其利弊得失，無法僅憑一隅而斷其全面， 7 因此，筆者以下謹試由談判利益、交易成本理論分析行政院版與民間版兩岸監督機制，解析兩岸談判困境，試圖解決我國當前所面對的僵局。
