    Title: 論立法院對兩岸經貿協定（議）之條約案議決權

    Abstract: 立法院對兩岸經貿協定（議）應享有憲法第六十三條的條約案議決權。本文透過大法官釋字和修憲過程之詮釋，而認為兩岸經貿協定（議）應屬憲法第六十三條所指之「條約」。雖大法官釋字第三二九號不將「臺灣地區與大陸地區間訂定之協議」視為「條約」，但其未否定台灣與中國間可形成條約關係。事實上，WTO協定即是中國以國家身份參與而台灣又同時為締約會員的協定。其次，為了形成條約關係的目的，可將「大陸地區」視為國家。根據大法官釋字第三二八號，統治行為決定領土，而中國對「大陸地區」有統治行為；又我國對「大陸地區人民」亦未以本國人對待，故「大陸地區」可視為國家。最後，兩岸經貿協定（議）屬WTO相關協定的延伸協定，非單純的雙邊關係，又涉及我國和第三國經貿關係的改變，故應屬於「協定類」的條約。因此，立法院應依憲法第六十三條審議兩岸經貿協定（議）。
