Title:	從裁判實務看無因管理制度的體系定位——以無因管理與不當得利之關系為切入

Abstract:	作為大陸法系債法中的兩大重要支柱,無因管理和不當得利一向被認為不僅在于處理利他的管理之后的費用求償,而且也在于調整財產的不當變動,民法學界一向認為兩者雖有競合,但制度上還是各有所本。但觀察兩岸的裁判實務,無因管理中的管理行為很少涉及行為義務,而集中于費用求償,大部分案例都與不當得利發生競合。在我國民法可以選擇對此二者粗線條立法,并不存在有如德、日民法及我國臺灣地區"民法"的概念區分的情況下,學說繼受應當立足于裁判實務,面向現代社會中法政策的實現問題,考慮無因管理獨立于不當得利而存在的體系價值。
