    Abstract: 誠信原則為私法關係之最基本原則,〔1〕而因保險契約所承擔的風險,其評估、控制與發生與否,受到要保人的誠信影響甚大,所以保險法制在傳統上對於要保人在誠信上的要求比其他契約類型更高,因而被稱為“最大誠信契約”或“最大善意契約”。但因為保險契約也是一種無形的金融商品,而要保人大多不具備保險的專業知識,加上消費者保護意識的強化,近年來各國立法趨勢對於保險人在誠信上的要求也明顯提高。誠信原則不僅在立法層面上直接影響保險法的製定與修正,也在個案的裁判實務中,影響法律以及保險條款的解釋,甚至對法律或保險條款的解釋作進一步的修正或補充。由於法律條文有限,而爭議案例的變化無窮,以誠信原則作為爭議案例的處理原則,自然有其相當的重要性。不過,也因為誠信原則乃極為抽象的上位概念,在運用誠信原則調整法律或保險條款的解釋適用時,必須相當小心謹慎,以免影響法律關係的明確性與安定性,甚或違反既有的法律政策。
