    Abstract: 2008年末,孫偉銘在四川成都酒醉駕車,連撞四車,導致四人死亡,法院以(1)孫某未持有合法駕駛執照;(2)孫某在事故發生當時,其血液酒精濃度高達0.13%;(3)孫某超速行駛並逾越中線;(4)孫某於肇事後逃逸,認為:(1)孫某無照駕車,無視交通法規;(2)肇事後逃逸足以證明其有犯案故意;(3)飲酒過量明顯無視公共安全,經一審判處死刑,二審改判無期徒刑。這是新中國成立以來,對酒醉駕車所導致意外傷判刑最為嚴歷之首例。媒體對此
    競相報導,甚至質疑法院量刑是否適當。本文之作,不在於探討孫某的刑事責任問題,而在於針對孫某一時不知節制所造成五個家庭(即包括孫某自己家庭及四位遭孫某撞及而身故之家庭)破亡,在民事上應當如何善後,也就是此五人之家屬應向何人追究民法上之賠償責任。
