    Title: 「誰」在做人權？中國兩次勞動法在台資企業實施結果的市場政治

    Abstract: 不同於先前研究強調國家與社會關係的面向，本文企圖再度回歸到市場力量的角度，以外銷產業為例，探討跨國資本中的國際買主與代工台商如何影響中國勞動法的實施結果。中國自1978年改革開放以來，正在進行一個嶄新的國家建構過程，在以東亞發展型國家作為範本，全力追求經濟成長的同時，由中國政府強力主導制訂的兩次勞動法（1995與2008）被認為是對市場力量的制衡。然而深究兩項政策的推動結果，卻發現跨國資本竟弔詭地成為影響中國兩次勞動法「能否執行」的主要行動者。因此，在思索形塑中國勞動條件的問題脈絡時，本文企圖帶入「市場政治」的觀點，再次分析全球商品鍊下，「國家－工人－資本家」三者之間在社會主義經濟體制轉型過程中的權力競逐關係，並且試圖進一步釐清每個角色範疇下之內部行動者對於提升勞動條件可能產生的影響。最後，本文將藉由勞動法這個個案分析，檢視國家獨斷專制權力（despotic power）與基礎行政權力（infrastructural power）兩者在中國經驗意涵的關連性。
