    Abstract: 專利並不保護思想。專利制度所保護者，乃是將思想落實或實踐之技術，亦即思想之實際應用。因此申請專利範圍中任一權利項，皆必須在抽象思想之外存在至少一個實際應用作為「有意義之限制條件」。本文初步建議，當專利申請人或專利權人欲主張其權利項並非涵蓋整個抽象思想而至少包含一個實際應用作為限制條件時，應負擔舉證責任提出至少一至二個具有相同抽象思想但非屬專利權範圍之實際應用。倘專利申請人或專利權人能提出，即可證明其專利並非涵蓋整個技術思想，從而屬於專利適格標的。
