Abstract:	價格擠壓(price squeeze, margin squeeze)係指一個同時經營上下游兩市場之垂直整合事業，其於上游市場具有獨占地位，而當下游市場其他競爭者要求與其交易時，垂直整合事業所訂定之批發價格相較於其零售價格，使競爭對于無利可圖之定價策略。這種以定價實質達到拒絕交易目的之行為究竟應該評價為垂直整合事業交易自由的範疇，或是違法削弱下游市場競爭之障眼法?？2003年歐盟執委會作出德國電信(Deutsche Telekom)處分案宣示價格擠壓違法，2008年歐盟初審法院(the Courtof First Instance)亦支持此見解，2010年歐盟法院(European Court of Justice)判決再度確認執委會及初審法院之決定。然而2009年美國聯邦最高法院作出linkLine判決，宣示價格擠壓並非獨立的競爭法違法類型。相同行為在世界二大經濟體被賦予截然不同的評價，因此引發筆者研究動機。以下將先簡介價格擠壓理論在美國及歐盟競爭法上之發展實務，分析美國linkLine及相關判決謹慎處理價格擠壓違法處分之背後考量，進而回應這些考量之適當性，最後以建立一套符合明確性、可行性的判斷標準，期待本文能在此議題發揮拋磚引玉之效。
