Abstract:	我國專利法第56條第3項規定：「發明專利權範圍，以申請專利範圍為準，於解釋申請專利範圍時，並得審酌說明書及圖式」，是為我國專利法中明定解釋申請專利範圍之法源依據。觀諸我國法院審判實務，無論是最高行政法院與智慧財產法院於審理專利新穎性或進步性時，或是最高法院與智慧財產法院於審理專利有效性（包含新穎性與進步性等要件）及侵權與否時，多會先解釋申請專利範圍。
