    Abstract: 「公私協力」、「自主規制」、「軟法治理」，係現今各國公法學界日益興盛之研究範疇。公私協力之概念源自歐體法之推動，歐體以克服財政緊縮與提升行政效率為由，促使國家自「獨占」經濟行政朝向「私化」，此一私化訴求催化「公私協力」之行為形式。而自主規制則起因於「政府管制失靈」，引發各國思考規制事務得否委託民間處理之風潮，自私化之觀點而言，自主規制實乃一種國家規制行政之「程序私化」。筆者長年以來之比較法研究基礎為日本行政法，故本文主要介紹最近日本之公私協力動向，並探討於此類現象中獨樹一幟管制手法之「自主規制」，間或提及美國及德國制度，以供我國學理與實務之參考。
