    Abstract: 著作人格權在國際智慧財產權法學界一直是個重要的問題，除了象徵著歐陸法系與英美法系不同的著作權哲學與價值外，也是國際著作權法調和過程中常被提出的重點課題之一，其中姓名表示權與禁止不當改變權更是著作人格權的論述焦點，由於該等權利具有一身專屬性，且在許多國家的著作權交易規範中都受到限制，此等特質與著作財產權純粹作為交易客體之性質截然不同，也因此，立法與司法實務上常面臨關於著作人格權處理方式之難題。姓名表示權是典型的著作人格權內涵之一，其價值與重要性歷久彌新，除了具有重要的著作人格實現特性外，對著作人而言，亦涵帶包括情感、尊嚴及財產等許多複雜因子涉及其中。 本研究將先觀察國際公約及外國法制對於姓名表示權的規範方式、理論基礎及侵害態樣，然後整理國內姓名表示權相關實務爭議與見解，探討文獻中關於姓名表示權之基礎理論、其他領域（如社會學、經濟學及心理學等）之相關理論（如與姓名、聲譽等相關之不同領域研究）與相互關聯，從著作人及利用人之不同角度構築適合國內著作權制度的姓名表示權理論基礎，並進而探討省略姓名表示權之社會慣例、數位時代中的姓名表示權處理模式（包含衍生著作及協同創作的姓名表示權問題）及其他如職務著作中的姓名表示權問題等。
