    摘要: 我國民法總則於民國18年制定後僅於74年檢討修正，迄今亦有二十餘年，因國際潮流的變遷、社會經濟發展及科技進步，新興法學理論之提出，實務判決之累積與演進，已有相當之素材，可供檢視民法總則現行規定是否仍符合社會脈動與時代需求。 本委託研究案將就現行民法總則相關規定及實務見解進行整理分析，並藉由研究團隊之專業背景，以外國立法例為借鏡，互相參考比較，綜合檢視我國民法總則之發展趨勢。
