Title:	強制辯護之研究

Abstract:	本論文共分六章第一章緒論：說明研究動機、研究範圍、研究方法、本論文之基本主張及為此主張之邏輯推理過程。第二章強制辯護概說：敘述強制辯護之意義、歷史沿革、立法理由、法律上效果、與各國立法例之現狀，藉以就強制辯護制度有一整體之認識。第三章我國強制辯護有關規定之檢討：現行法下，有關強制辯護之一切規定，如強制辯護案件之範圍、強制辯護案件之審理、強制辯護人等，從比較法上之觀察，作立法論上之檢討。第四章強制辯護人之地位：關於強制辯護案件辯護人之問題，尤其是審判長指定辯護之性質、指定辯護人之解任、辯護人地位之公益性、辯護人之真實義務、及受指定之律師得否請求報酬等，就學術上與實務上之觀點詳予探討。第五章強制辯護案件實施概況之檢討：以理論上之應該面為基準，就我國現行實務，有關處理強制辯護案件之程序、強制辯護權之始期、強制辯護於上訴審之適用等問題，加以檢討。第六章結論：總結前述各章之論點，提出筆者對我國現行強制辯護制度之改進意見。
