Title:	不純正不作為犯之研究

Abstract:	由於不作為之隱微性，以及個人主義下犯罪觀念偏重於權利或法益之侵害，不純正不作為犯理論發展極晚，各國立法者亦遲至本世紀三○年代以後，方漸次重視明文處罰不純正不作為犯之問題。民國廿四年，我國現行刑法制定之時，於第十五條規定：「對於一定結果之發生，法律上有防止之義務，能防止而不防止者，與因積極行為發生結果者同。因自己行為致有發生一定結果之危險者，負防止其發生之義務。」可謂開不純正不作為犯立法風氣之先。究其內容，較之稍早的義大利一九三○年刑法第四十條及稍後的希臘一九五○年刑法第十五條、南斯拉夫一九五一年刑法第十三條，毫不遜色，實為我刑事立法史上進步表現。唯我國刑法制定之際，正當以作為義務為中心之不純正不作為犯理論研究伊始，雛形初具，理論構造未臻精密，本法制定之後，德國學界繼續對不純正不作為犯理論，作更進一步之闡論，卒於本世紀六○年代前後，獲致突破性之結論，而建立以保證人義務為中心，以獨立的構成要件判斷為等價性標準之理論體系。相形之下，昔日為人所稱道之現行刑法第十五條，其處罰體系即有欠完備，遂有藉助於最新理論之探討，予以重新檢討之必要。在感於此，乃參酌德、日等國學說與判例之見解，以及最新立法例，就最新之理論精義，依個人之瞭解加以介紹，並略抒己見以成本論文，期有助於刑法第十五條解釋、適用、及修正之參考。
