Title:	刑事被告自白之研究

Abstract:	被告之自白，以出於任意，即本於自由意思之發動，為取得證據能力之要件，向為英美法及大陸法所共認，稱為自白任意性法則，我刑事訴訟法亦明認此一法則，於第一百五十六條第一項定曰：「被告之自白，非出於強暴、脅迫、利誘、詐欺、違法羈押或其他不正之方法，且與事實相符者，得為證據。」至於自白之證據價值，本乎大陸法系自由心證主義，原應由法官自由裁量之，但我刑事訴訟法為防止偏重自白之危險，並擔保自白之真實性，則又採英美法之理論，以法律直接對於自白之證據價值加以限制，即以有補強證據為必要，而於第一百五十六條第二項明定「被告之自白，不得作為有罪判決之唯一證據，仍應調查其他必要之證據，以察其是否與事實相符。」有關被告自白之處理，我刑事訴訟法之規定，雖稱簡賅，然其間所涉疑難，則至為繁夥，亟待探討解決。爰以我刑事訴訟法所採之基本訴訟制度為中心，參酌英美、日本之實例及學說，依次論述其要，而成斯篇，都六章八萬言。茲述各章要旨如後：
