    Title: 中國參與國際核安全規範法典化之解析

    Abstract: 有關中國參與國際安全規範法典化機制的效應，可分別從三個面向來看：第一，從 功能角度來看：有關安全保證，中國理應自我約束，承諾在何種狀況下不會對無核國使 用核武。有關出口管制，主導國的策略為通過同質化的手段從而調和建制成員的利益， 藉此來確保建制的有效運作。有關核裁軍，無核國要求所有締約國透過談判結束核軍備 之最終願望，在本質上屬於中國自我約束的範疇。有關保障監督，乃是規範無核國以及 核武國的行為，本質上仍然屬於同質化。有關無核區，此舉為無核國以共同命運來追求 無核環境之集體意志彰顯。有關和平使用核能，無核國視為其當然權益，也是彼等相互 依存、經濟發展的必要手段。第二，從主導策略方面來看，又可根據中國其他核武國以 及無核國來區分。第三，從內化程度衡量中國以及無核國在特定議題上對國際安全規範 的差異，可分為高、中、低三個等級。上述的法典化機制是以身份屬性建構行為的前提 作為概念上的區分。這些機制可為我們進一步了解各項策略之相對有效性，並可進行系 統性評估的基礎。本計畫將通過質化分析，逐次就上述這四項指標〈主導集團、社會化 機制、主導策略、內化程度〉，分別在這六項功能〈安全保證、出口管制、核裁軍、保 障監督、和平使用核能、無核區〉就中國之言語行為進行內容分析並彰顯其規範理論意 涵。為此，本計劃將根據有關核安全規範上述的六項功能，中國與此一軍控建制的法典 化互動進行全面性的實證分析。
    With regard to the impact generate by the legalization of nuclear norms on China, one can summarize as follows: First, the functional perspectives, on security assurance, China should impose self restrain to honor a no to use pledge: on export control, the dominant state would use a homogeneous means to coordinate the different state interests; on nuclear disarmament, China would impose a self restraint; on safeguard, norms are to be observed; on nuclear weapon free zone, non-nuclear would have interest at stake, and on peaceful use of nuclear material. Secondly, on the dominant strategy perspective, one can measure the difference between nuclear and non-nuclear states. Thirdly, on the internalization, one can measure different degree of internalization of the international norms. This research will follow the above indicators to measure various degrees of impact on Chinn’s stances derived from speech actions.
