    Title: 刑事責任能力之研究

    Abstract: 刑法上之「責任」(schuld;verschuldung)要件，一般又分為「責任能國」( schuldfaohigkoit;zurochnungsfaehig koit)與「責任條件」(z—urechenbarkeit dor Tat)。刑法中對於責任能力鮮有自正面為積極規定而相反的多消極的規定其阻卻之事由，卻長行為人之精神狀態是否正常，作為科以刑事責任之準璩。刑事學者對於責任能力概念的理解，因所持觀點不同，亦有所差異。古典派的學老持道義的責任論，以為凡具有自由決定意思之能力，而有辦別善惡之認識老，對其所為之行為，即應負道義上的責任。在此意義之下，所謂責任能力，實卻「自由決定意思之能力」(frei willensbe－timmung)，亦即「辨別是非的能力」(aiseernemnt;die zur Erkenntnis der strafbarkkeit erforderliche Einsicht)。換言之，即以責任能力為「意思能力」(willensfaehigkit)乃至「犯罪能力」（Delikfaehigkoit)。實證派的學者則根本否定人有自由意思，而持社會的責任論，以為人是構成社會的分子，皆有不侵害社會之義務，故對其行為應負社會責任。全國博士碩士論文室基此觀點，則所謂責任能力即是依科刑可以達到刑罰防衛社會目的之能力，即「依刑罰而適應社會的能力」(anpas sungsfaehigkeit)，亦即「受刑能力」(sungsfaehigkeit)。但道義責任論與社會責任論者均依行為人的精神狀態為異其處分之準據，則無不同（其本質上之差異，則伋另一問題），所以責任能力與精神狀態之關係，非常密切，而精神狀態係精神醫學與心理學上之問題，從而刑法學與精神醫學及心理學之關係，亦可想見，誠如日本刑法學者西村克彥所言：「刑法上的責任能力問題，係刑法學與精神醫學及心理學之境界問題」（見昭和三十二年西村克彥著」刑事責任能力論」）
