Title:	從法治國家思想之演變論依法行政原則

Abstract:	我國行政法學起步較遲，復受國家局勢動亂之影響，體系之建立，較之其他法學，欠缺完整性，對於「法治國家」之基本要求－「依法行政」原則，乃未能有深刻之體會，故於行政實際上，常有未盡合法之處。本論文所欲努力者，在闡述行政與法所應有之關係，期使行政之運行有一定之規範可循，以臻於法治國家之理想。本論文約十一萬言，計分七章。首章說明依法行政原則所由發生之法治國家思想之來源、演變，以瞭解法治國家思想在不同時空中之需求，進而乃可正確把握依法行政原則之現代意義。第二章至第六章、，分別就大陸法系之德、端、日與英美法系之英、美等各國，敘明其對依法行政原則之實踐，期借他山之石，鍼砭我國之得失。第六章歸納我國依法行政原則之現狀，指出其缺憾，並以各國之經驗，提出個人之意見。本論文之撰寫，蒙恩師翁老師岳生剴切指導，解釋疑難；文稿初成，又逐字批注斧正，師恩似海，永生難忘。城老師仲模惠借資料，指點迷津，受益匪淺。臺大學長林鍚堯、葉百修、蔡志方、湯德宗等，或協譯德文資料，或提供參考資料，高金枝、蔡瑞煙、吳建勛、李麗芳、黃明絹、潘麗玲等學長協助繕寫校對，使本論文得以順利完成，在此一併致謝。本文所牽涉之問題相當廣泛，筆者學殖仍淺，不免有錯誤、疏漏之處，唯祈法學先進不吝指正，使筆者得以繼續研究改進。
