    Title: 我國之容積移轉制度

    Abstract: 作為古蹟土地利用限制之損失補償手段(文化資產保存法三六之一),我國於八十七年訂定「古蹟土地容積移轉辦法」(以下簡稱「古蹟」),創設容積移轉制度。未久,為促進都市更新地區土地之更有效利用,容積移轉制度亦導入於都市更新事業中(都市更新條例五至八、四五Ⅰ)。復為促進都市計畫公共設施保留地之取得與保存維護歷史建築等目的(都市計畫法八三之一),八十八年又訂定「都市計畫容積移轉實施辦法」(以下簡稱「都市」)。所謂容積移轉,係指原屬一宗土地(送出基地)之可移出容積,移轉至其他可建築土地(接受基地)建築使用而言。而容積,則指土地可建築之總樓地板面積。
