Title:	電腦軟體與網路資訊保險法律問題之研究

Abstract:	本文係就電腦資訊中，軟體開發與網路侵害行為兩項作為討論之主題，探討其中相關之法律保護與風險轉嫁之問題。筆者擬於第二章介紹保險制度所能提供電腦資訊之保障，並先點明電腦資訊潛在風險之嚴重性；於第三章探討法律制度保護智慧財產權之現況，並參考美國商業部於1995年9月所公佈，針對智慧財產權之保護與侵害責任歸屬的之白皮書(Intellectual Property and the National Information Infrastructure,September 1995)，闡述電腦軟體之各種法律保護，最後並嘗試提出較為可行的優先保護方式；接著於第四章、第五章依現行保險慣例之分類，分別從自己損害之保險保護（損失險），與對第三人責任義務之保險保護（第三人責任險）之角度切入，依先前所述智慧財產權對於電腦軟體之保護，再嘗試以類型化之方式找出開發過程中與軟體開發完成後之可能風險，並就風險之可保性作一初步之分析。
