Title:	公務人員行政中立之研究

Abstract:	公務人員行政中立的問題，本就極為錯綜複雜，並非一蹴可幾。關於我國公務人員行政中立的問題，過去大家避而不談，近年始體認公務人員行政中立的重要。本文就公務人員行政中立的內涵、相關因素等加以探討，並佐以先進國家的制度或作法，藉以瞭解我國所存在的各種問題，並嘗試研擬今後適切可行的作法，供中央人事行政機關於人事政策及目標方面的參考採擇，期能有助於我國公務人員行政中立原則的健全發展。本文共分為六章，首章緒論指出我國公務人員行政中立問題的存在，值得研究；次章為行政中立原則的發展及時代需要，公務人員的地位是隨著時代演進而異，民主政治發展的結果亟需行政中立；第三章為行政中立的內涵及相關因素的探討，至公務人員應否行政中立，向有正反不同的見解，惟一般以限制的情形居多；第四章以問卷調查結果，發現我國公務人員行政中立的情況與問題所在；第五章為先進國家有關行政中立的規定或作法，從敘述中歸納出可供我國借鏡之處；第六章結論提出我國今後適切可行的作法。欲使我國公務人員真正做到行政中立，應從觀念確立與法規制定雙方面手。前者如劃清國家、政府、政黨三個概念的分際，認同行政中立的價值，政府遵守法令等；後者如區分政務官與事務官，研擬法規及制度，健全文官制度，考試權獨立行使，建立公務人員的獨立管理系統，建立公務人員申訴制度，訂定違犯政治活動禁制規定的罰則等。
