Abstract:	第一章說明禁止翻供原則於國內法之概況，期澄清若干基本概念，以利下列各章對於本論文主題之闡述。第二章探討國際法上禁止翻供原則之定義、形式、成立要件、其是否居於實體法之林、及是否成為一般法律原則等問題以及相關疑義。第三章將此原則與「默認」、「確定判決」、「承認」、「衡平原則」及「認諾」等五個法律原則相比較，分析其異同，期能對禁止翻供原則有較深刻之認識。第四章以常設國際法院一九三三年判決之「東格陵蘭島法律地位案」，國際法院一九六○年判決之「西班牙國王仲裁判決案」以及一九六二年判決之「浦里維哈寺廟案」為例，觀察禁止翻供原則之實際運用情形，俾使理論與實際相配合。第五章為結論。將前四章之內容作一回顧，說明禁止翻供原則於國際法上適用之實益。
