Abstract:	論文共一冊，約九萬字，共分七章二十三節，提要分述如下：第一章前言討論研究的動機、研究的方法及敘述提要第二章載貨證券總論共分四節討論載貨證券之意義與種類、載貨證券之性質、載貨證券之功能及載貨證券之印刷條款。第三章載貨證券與貨物運輸之關係共分五節，討論載貨證券與租傭船契約之關係、載貨證券與甲板貨物運輸之關係、載貨證券與貨櫃運輸之關係、載貨證券之背書與轉讓、載貨證券之認賠書。第四章載貨證券與貿易條件之關係共分三節，討論載貨證券與貿易貨物所有權之移轉載貨證券與貿易貨物危險負擔之移轉。載貨證券之提供、所有權之移轉及危險負擔之移轉。第五章載貨證券之準據法討論載貨證券附加之至上條款、載貨證券附加之法庭地條款及載貨證券上附加之仲裁條款。第六章貨損理賠雙方當事人之舉證責任討論載貨證券舉證責任制度之演變、貨損索賠人主張損害存在之舉證、運送人主張免責之舉證責任、貨損索賠人提供反證之舉證責任第七章結論與建議
