Title:	我國有線電視法草案評析

Abstract:	行政院於民國七十二年成立工作小組，對有線電視進行政策研究，直到民國八十一年一月通過有線電視法草案，本文即針對該草案的內容進行評析。　　本論文包括三部分：第一篇緒論敘述研究動機，簡介有線電視、並說明先進國家與我國之有線電視政策及立法，建立對有線電視之基本了解，作為評析草案的基本知識。第二篇依有線電視法草案條文的順序，分為七章：第一章總論、第二章主管機關、第三章營運許可、第四章節目與廣告規範、第五章費用規範、第六章技術與設備規範及第七章權利保護。分別闡釋相關條文的立法真意，並與外國立法例加以比較，同時徵引國內外學者專家、傳播業者（包括有線業者）及行政機關的見解，討論草案的利弊得失及可能的適用效果，第二篇為本論文最重要的部分。第三篇對草案作出結論，並對實務適用及未來的相關研究提出建議。　　有線電視法草案規定經營有線電視須經特許，且採一地一系統，在此前提之下，為保障大眾的權益，因而有若干管制性規定。隨著傳播科技的進步、社會環境的變遷，營運及管理經驗的累積，將來通過的法案應隨時間作適當修訂，使法律與日俱進。
