Abstract:	我國關於離婚婦女之經濟安全保障，於民法中之規範包括離婚時夫妻財產之清算與分配、贍養費與子女扶養費之請求，並在年金改革中，於相關之特別法中納入對於離婚配偶之退休金分配，惟上述規範在法規面上是否足以使離婚婦女之經濟安全受到相應之保障，又在落實法規之相關請求權上，是否有無法實現之障礙與困難，乃為本次計畫之研究主軸。本研究將透過分析裁判離婚及協議離婚之相關文獻與個案、透過對外國法制之比較，研析離婚時財產分配、贍養費、子女扶養費之雙方決策及其原因、協議或裁判及其領取情形、訴訟過程中可能遭遇之經濟困境情形、對於離婚後經濟生活、扶養子女之影響等，以檢討我國現行法規及制度對於離婚配偶經濟分配之公平性，從而提出具體之法規修正或政策建議，以作為未來政策方向之參考。
