    摘要: 跨領域的專利侵權、電子商務交易的複數主體與多元分工的專利侵權、以及立體列印技術下的專利侵 權前置化等問題，其爭議性及對專利法本質的衝擊，已逐漸浮現於各國專利法之法制、學說理論與司 法實務。就我國現行專利法之規範，似無直接解決之道。本計晝之目的，首先要重新檢討反省專利法 的「全要件原則」、屬地主義與法定排他權的傳統評價，並擬以衡平之因素，加以調整其解釋適用之 僵化，以令專利法能切入產業價值鏈跨境交易與科技發展的利益衡量，尋就專利直接侵權與間接侵權 的新定位，確保專利權人於相關侵權下充分且合理的救濟。
    The disputes concerning cross-border infringement, divided infringement and early infringement resulting from the 3D printing have brought about substantial impacts upon patent law system, and induced much debate in the amendment of patent act, academic studies and judicial practice. There is no proper approach under Taiwanese patent law to resolve such the disputes. The main purpose of the project is to assuage the rigid application of patent law to catch the interest balance between the facilitation of cross-border trades or the implementation of emerging technologies and the protection of patent rights, through the overall reviews of the tradition evaluation about the all-element rule, territoriality and the exclusive rights, as well as the equity consideration. Meanwhile, the project also attempts to justify the recognition of indirect infringement under patent law, and ascertain its function with direct infringement to provide the patentees with sufficient remedies to deal with the new types of patent infringement.
