    Abstract: 本計畫以「經濟行政訴訟事件裁判評析」為題,擬對我國行政法院歷年來與經濟行政法相關之行政訴訟裁判進行評析。在法律學門領域之歸屬上,本計畫主題涉及行政法學各論中之經濟行政法範疇。有鑑於經濟行政法範疇寬廣,本計畫之研究標的排除計畫主持人之前已執行之國家參與私經濟活動的公營事業法制及公私協力法制兩部分,而僅聚焦在「經濟監督法」、「經濟引導與促進法」,以及「經濟管制法」三大傳統範疇。
    在執行期程上,本計畫規劃為三年期。第一年以「市場進入及留續之經濟管制行政」為子題,分析涉及營業登記、許可及特許相關爭議之行政法院裁判,以及營業執照換照行政訴訟事件之裁判。繼之,第二年以「私經濟活動之經濟監督行政」為子題,聚焦在停止營業、勒令歇業、廢止營業許可、停止進入市場等經濟監督措施相關行政法院裁判評析,並且將研究視野擴及至其與經濟行政法上義務違反而遭受到行政罰間之區隔問題。最後,第三年以「經濟引導與促進行政」為子題,探討行政法院裁判中涉及經濟引導及促進措施(例如經濟補貼、租稅優惠、中小企業貸款、設廠及擴廠用地之取得、協助參展、產業創新獎勵等)之爭議事件。
    計畫主持人長年專注且耕耘公經濟法領域,歷年來業已累積不少之研究成果。此外,計畫主持人長年來在行政法總論領域亦保持密切之研究關聯性,且有一定之研究心得及專文發表。基此,計畫主持人自信應具備本研究計畫執行上所需之基礎專業知識與能力。本計畫之執行,預估至少應可創造出「建構經濟行政法領域之典範裁判案例」、「促進經濟行政法作為行政法各論之一獨立部門法」以及「為形塑國家經濟發展完善法制環境提供建言」等面向上之研究價值及貢獻。
    This research project (the “Project”), “The Review over Court Decisions Concerning Economic Administrative Law”, deems to review and analysis the relevant court decisions concerning economic administrative law delivered by administrative courts over the past years. Regarding the category of this Project in the field of law, the topic of the Project involves the domain of economic administrative law, a particular field of study in administrative law. Due to the vastness of its essence, the objective of Project excludes two parts that had been conducted by the project director, namely, the regulations of state-owned enterprises when the state participating in private activities and the public-private partnership. Instead, the Project focuses mainly on the three typical regulatory topics, “economic supervisory,” “economic guidance and enhancement,” and “economic control.”
    As to the task and timeframe, this Project is to be conducted under a three-year plan. The first-year sub-topic is “the administrative regulations of economic control of the entrance and continuance in the market,” which analyses the business registration, permit, and charter, and relevant issues of administrative court decisions. The second-year sub-topic, “economic supervisory administration of private activities,” focuses on administrative court decisions regarding without limitation business suspension, termination of business, revoking business permits, and suspension of entering markets, and broadens the coverage of this Project into the study on the distinction issue arose from cases receiving administrative penalties due to breaching of economic administrative law obligations. Lastly, the third-year sub-topic, “economic guidance and enhancement,” discusses those court decisions involving issues resulted from using economic guidance and enhancement measures (such as subsidies, tax incentives, SME loans, land acquisition for set-up and/or expansion of factories, supporting exhibitors, or industrial innovation incentives).
    The project director has been dedicating to the studies concerning economic administrative law and established a great number of achievements over the years. Besides, the project director has also devoted to the study of general administrative law, accumulating a certain amount of research experiences and publications. On that basis, the project director is fully capable of conducting the Project, and may provide contributions, including without limitation the “model of economic administrative court decisions,” “promoting economic administrative law to become a specific field of study in administrative law,” and “advice regarding the completion of regulatory structure in economic development.”
