    Abstract: 水下文化資產保護之法制,在國際法與其他外國立法例中已有長足發展。考量到水下文化資產保護之重要性,並因應此種國際發展趨勢,為水下文化資產保護進行相關立法已刻不容緩。行政院文化部(文化建設委員會)參考《水下文化遺產保護公約》與各國立法例,研擬「水下文化資產保存法」(草案),其中確立水下文化資產現地保存之原則,而水下文化資產保護區之劃置則為現地保存之方法之一。關於保護區之劃設與管理授權主管機關為之。因此,本委託研究計畫預計從國際法與比較法的角度出發,分析國際法、外國立法例與我國法制,進一步完成研擬保護區之相關管理辦法。
    The legal regime regarding the protection of underwater culture heritage has been developed in international law and domestic laws of other States. Taking into consideration the importance of underwater cultural heritage and following this legal development in the international society, to initiate the development of this legal regime in Taiwan is necessary. The Ministry of Culture, R.O.C. referring to the UNESCO Convention on the Protection of Underwater Cultural Heritage and the domestic laws of other States, drafted the Underwater Cultural Heritage Protection Act and ensured that preservation in situ is one of the principles of the protection of underwater cultural heritage. Moreover, to design the underwater cultural heritage protected areas is one of the approaches to preservation in situ. The governing agency is authorized to design and manage the protected areas. Therefore, based on the analyses of international law and the comparisons between the legal regimes of Taiwan and other States, this research project intends to draw up the regulations governing the underwater cultural heritage protected areas.
