    Abstract: 本研究計畫,首先將回顧「國際人權法典」及《禁止酷刑和其他殘忍、不人道或有辱人格的待遇或處罰公約》,瞭解國際公約中對於酷刑之定義、要件設計及相關義務。接著,將整理我國現行酷刑相關規範,在普通刑法部分,將探究各條文之保護法益與罪質,並一併檢視規定於普通刑法外之其餘規範,以掌握我國現行對於酷刑之觸及範圍。再來,將以比較法學研究方式,參考德國關於酷刑之規範與註釋書,同時檢視德國相關實務案例,觀察其實際適用上之情形,作為我國酷刑罪增訂與否之借鑒。最後,再針對我國酷刑立法之必要性與可行性進行分析,並提供可能之具體修法建議,作為主管機關未來修法之參考。
    Firstly, this project aims to review the definitions, elements, and obligations for the crime of torture as outlined in the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. By understanding the international conventions' regulations on the prohibition of torture, the project seeks to analyze the specific requirements required by the convention and explore the essence and implied meaning of torture", including the legal goods that the crime of torture intends to protect and the characteristics of torture acts. Next, this project explores the appraisal of "torture" under Taiwanese criminal law, examining the scope of protection provided by criminal regulations. It also reviews how these regulations are practically applied in our country to determine whether the current laws and practices sufficiently address acts of "torture". Subsequently, a comparative legal research methodology will be conducted to analyze the corresponding regulations and commentaries on "torture" in Germany. This will include observing the practical application of these laws through German case studies and considering Germany's current status in preventing torture. These findings serve as a reference for researching whether add the crime of torture or not. Finally, this project discusses the necessity and feasibility of adding the crime of torture, proposing three possible legislative options and providing specific elements of crime as references for the competent authorities in future criminal law amendments. The first is to add Article 126-1 "Crime of Torture" into the Criminal Code, in accordance with the Convention Against Torture of United Nations. The second is to add new behavioral pattern of Article 277 "Offences of Causing Bodily Harm" in the Criminal Code, referring to the understanding for the legal interest of body in German. The third is to emphasize the importance of "Human Dignity" by adding Article 296-2 "Crime of Torture" into the Criminal Code.
