Abstract: | 隨著數位治理的興起,各國政府積極運用資訊科技提升公共服務效率與品質,然而在高度專業化與規範化的司法領域中推動數位轉型,往往面臨跨部門協調、制度調整與專業知識整合等挑戰。司法院自2019年起在民事強制執行業務中導入線上聲請系統,期望透過科技應用簡化流程、提升案件處理效率,並回應司法服務數位化的政策趨勢。此一過程牽涉公部門與民間系統開發廠商的跨部門協力合作,成為觀察司法數位轉型與協力治理互動模式的重要案例。 本研究旨在探討該系統推動過程中,政府與協力廠商如何透過協力治理模式推進數位轉型專案,並分析不同障礙類型對合作歷程的影響。基於Ansell與Gash(2008)提出的協力治理理論,結合Vogelsang等人(2021)數位轉型障礙分類,本研究透過深度訪談蒐集司法院與協力廠商的相關資料以回應研究問題。 研究發現,專案啟動契機源自政策導向與任務需求的推動,高層支持與中階領導的協調是合作關係建立的關鍵。影響協作互動的因素包括制度設計的包容性、持續溝通與信任培養,以及跨部門資源共享。然而,專案推動過程中亦面臨多重挑戰:包含跨系統介接與技術整合的技術性障礙、內部資源與專業能力不足的組織性障礙、成員經驗差異與溝通落差的個別性障礙,以及法規更新滯後與跨機關協調不足的外部性障礙。研究進一步指出,制度調整與靈活資源運用有助於降低部分障礙影響,並促進專案成效的呈現,如案件處理效率提升與使用者體驗改善。 綜合分析結果,本研究認為協力治理理論與數位轉型障礙理論的整合,能更完整揭示司法領域數位化推動的複雜性與多層次互動,亦補足現有文獻對司法案例研究的不足。實務上,此研究可為未來在高專業性與高度規範性環境中推動公私協力的數位專案提供參考;學術上,則深化了協力治理與數位轉型理論的交叉應用。 With the rise of digital governance, governments around the world are actively leveraging information technology to enhance the efficiency and quality of public services. However, promoting digital transformation in the highly specialized and regulated judicial sector often presents challenges such as interdepartmental coordination, institutional adjustments, and the integration of professional expertise. Since 2019, the Judicial Yuan has introduced an online application system for civil enforcement proceedings, aiming to streamline processes, improve case handling efficiency, and align with the policy trend toward the digitalization of judicial services through technological applications. This process involves cross-departmental collaboration between public agencies and private-sector system development partners, making it an important case study for observing judicial digital transformation and collaborative governance interaction models. This study aims to explore how the government and private-sector partners drive digital transformation projects through collaborative governance models during the system implementation process, and to analyze the impact of different types of obstacles on the collaborative process. Based on Ansell and Gash’s (2008) collaborative governance theory, combined with Vogelsang et al.’s (2021) classification of digital transformation obstacles, this study collected relevant data from the Judicial Yuan and its partners through in-depth interviews to address the research questions. The study found that the project was initiated by policy imperatives and operational demands, and that high-level support and coordination among mid-level leaders were critical to establishing the collaborative relationship. Factors influencing collaborative interactions included the inclusiveness of institutional design, sustained communication and trust-building, and cross-departmental resource sharing. However, the project also faced multiple challenges during its implementation, including technical obstacles such as cross-system interfacing and technological integration, organizational obstacles such as insufficient internal resources and professional capabilities, individual obstacles such as differences in member experience and communication gaps, and external obstacles such as lagging regulatory updates and insufficient inter-agency coordination. The study further points out that institutional adjustments and flexible resource utilization can help mitigate some obstacles and enhance project outcomes, such as improved case handling efficiency and user experience. Based on the comprehensive analysis, this study concludes that integrating collaborative governance theory with the theory of digital transformation obstacles provides a more holistic understanding of the complexity and multi-level interactions involved in promoting digitalization in the judicial sector, while also addressing the scarcity of judicial case studies in the literature. Practically, the findings can inform future digital initiatives aimed at fostering public-private collaboration in highly professional and regulated environments; academically, they contribute to the cross-application of collaborative governance and digital transformation theories. |
