Title:	再生醫療立法及產業發展的倫理與社會基礎︰以利益衝突、審議會多元性、病人救濟措施與權益保護為例

Abstract:	立法院於 2024 年 6 月，三讀通過《再生醫療法》、《再生醫療製劑條例》，為我國再生醫療研發、臨床執行及產業發展，開啟了新的管理架構與展望。然而，在其前一年，行政院向立法院提出的這兩部法律的草案，曾經引發許多醫藥科學專家學者及民間團體的強烈質疑，並一度使得立法院暫緩立法。本文希望探討再生醫療雙法於 2023 年至 2024 年的立法過程中，部分重要的爭議以及後來三讀通過的相關條文的因應，如：再生醫療商業利益與利益衝突、再生醫療審議會之組成與功能、病人發生死傷醫療事故時的救濟措施。然後，基於這些討論進一步提出再生醫療產業若是希望長遠發展，主管機關及醫療機構或業者應該考量的一些倫理、社會與法律基礎。本文建議主管機關未來執法時能注意日本雙軌架構在該國已經發生的問題，並落實告知後同意、弱勢族群保障、個人資料保護、醫療資訊公開透明等倫理與法律要求，以確保社會信賴，使得再生醫療的發展與其產業能夠有長遠的展望，而非僅一時的龐大商機或病人短暫的希望。
