    Title: 從複製的權利到文化的權利

    Abstract: 教育部在2007年底受到財團法人國際唱片業交流基金會（IFPI）施壓下開始約束學術網路的使用，使得部分大學開始規範P2P下載軟體的使用，像是IP的監控，上下載異常流量的管制，教育部針對交換軟體的使用提出了兩點意見，「就經濟層面言，著作權產業將受到重創，就人文層面言，道德、文化素養將日趨沈淪」。（教育部，2007）長期以來，雖然並不成功，著作權在台灣社會以國家道德力量作用著，複雜的資本主義邏輯（如著作權產業是誰？）與文化近用、文化生產權利間的矛盾關係，似乎都在「禁」的氛圍中無法討論，只能實踐，留下的只有抽象的法律原則。今天教育部在特定產業壓力下規範了盜版音樂下載，明天要規範盜版電影，還是盜版電視劇的下載？文字、影音的內容種類何其多，交換軟體的禁止形同文化的檢查制度，如同「重製」本身是複雜的文化作為。本文引介、評論香港電影研究學者彭麗君的專書，希望藉此機會擴充盜版與文化之間關係的討論，用更動態的「文化」論述介入僵化的「國家文化」、「文化素養」、和「文化產業化」的假設。
