| Abstract: | 相較於世界上多數國家在近代社會運動上鮮少出現總罷工的情形，法國至今仍有工會發起罷工並成功號召公私部門的勞工一同參與並形成總罷工的現象，但由一般勞資關係的脈絡觀察，甚難想像某範圍內同一時間所有的勞工與雇主皆發生勞資爭議，進而產生總體性的罷工或勞資爭議情形。因此，本文欲藉由探討法國總罷工的歷史背景及發展因素，進一步分析法國罷工法秩序下為何會允許總罷工的出現，以及法院現今以何種標準劃出總罷工行使之界線等問題。本文研究發現，總罷工自19世紀末期工會合法成立後即頻繁地出現在法國勞工運動史上，並由最初勞動總聯盟(CGT)欲透過總罷工達到推翻資產階級革命的用意，至今日各工會將總罷工作為代表爭取整體工人階級利益之手段，且法院因肯認勞工當具有相關利益時，可行使政治性罷工及團結性罷工，因此工會仍具有號召不同企業內的勞工同時罷工而形成總罷工的可能性。另一方面，法院對於總罷工的行為標準採行與一般罷工相同的評價，雖由憲法委員會肯認罷工權為共和國法律承認的基本原則，同時法律規範除非重大過失否則不得解雇罷工者，但行使時仍需以避免限制非罷工者的工作自由為原則及避免違反相關普通法之規範，否則仍將可能因構成重大過失而遭到解雇。
General strikes seldom happen in other countries, but French trade unions successfully launch the general strikes and call for the labors in public and private sectors at present. Comparing to the single labor conflict of normal strike, we are hard to find out that all the labors and employers have labor conflicts and bring about the general strikes or labor confliction in one region. This thesis is discussing about the history background and the factor of development of general strikes in France and seeking for the reasons why courts approve the trade unions to launch a general strike nowadays and that courts used the orders about general strikes. There are two conclusions after research. First, general strike appeared constantly after the legalization of trade union in the end of 19th century. The meaning of general strike is to transform the overthrowing the bourgeoisie into representing the overall interests of the working class today. In addition, the courts admit that labor can take the political strike and sympathetic strikes when there are interests relating to themselves. Hence, trade unions can launch the general strikes via political strikes or sympathetic strikes currently. Second, the judicial systems adopt the same standard of normal strikes to general strike and the Constitutional Council (Conseil Constitutionnel) accept it as one of the fundamental principles acknowledged in the laws of the Republic (PFRLR). The French labor law prohibits employers to dismiss strikers without gross negligence, so strikers have to prevent themselves from taking actions with the gross negligence like limiting the freedom of work of non-strikers and violating the common law. |
